Terms and Conditions
General Use & Liability
Appliances, furniture, and facilities are provided for guest use at your own risk. We are not liable for any injury, loss, or damage to personal property.
We regularly service appliances including the pool, fridges, air conditioning, heaters, and the home lift to ensure safety and functionality.
Any damage caused due to misuse must be paid for by the guest.
No refunds or cancellations will be offered for appliance failures due to external factors (e.g., power outages, breakdowns). However, we will make every effort to resolve issues promptly.
We are not responsible for gas, electricity, water, or internet outages due to circumstances beyond our control (e.g., storms, planned outages). Contact us for assistance if needed.
Lift Usage
Lift callout fees start at $500 and will be charged if misuse (e.g., jumping, dropping objects) requires service.
Lifts can often be reset easily; please contact us before requesting a technician.
Toys & Games
A variety of games and toys, including a ping pong table, are provided. Please pack up after use.
Pool Rules
Pool use is permitted between 8:00 AM and 9:30 PM only.
Heated pool requests require at least 48 hours' notice, and while we strive to maintain 28-32°C, heating is not guaranteed.
No refunds or cancellations for pool-related issues beyond our control (e.g., power outages, equipment failure).
Weekly servicing is conducted, and additional cleaning may occur during your stay.
No refunds for natural debris (e.g., leaves, insects) in the pool.
No glassware in the pool area; plasticware is provided.
Adjusting pool equipment is prohibited. Any tampering requiring technician service will be charged to the guest.
No music is allowed in the pool area.
Risk & Responsibility
Staying at Deja View Mount Martha is at your own risk. We are not responsible for injuries, accidents, or damage to personal belongings and vehicles.
If you notice anything requiring attention, contact us immediately.
Wi-Fi & Phone Usage
We are not responsible for internet speed, outages, or mobile coverage.
Internet is provided for basic use (emails, social media, browsing). Streaming or large downloads may incur additional charges deducted from your security deposit.
Pets
Pets are not permitted unless pre-approved. Approved pets incur a $500 fee per pet and a $1500 pet bond.
The yard must be cleaned before checkout. Minimum cleaning fees start at $300.
Visitors are not allowed to bring pets.
Cleaning
The property is cleaned before arrival. Report any issues within 2 hours of check-in.
Guests must leave the home in a clean state. Excess cleaning fees may apply.
All food must be removed from the fridge and pantry.
BBQ must be cleaned after use, or an extra charge will apply.
Construction & Noise
We are in a residential area. Nearby construction noise is beyond our control and does not warrant a refund.
Established luxury homes surround us, making disruption unlikely.
Rubbish Disposal
Bins go out Tuesday night (extra collection on Monday night).
Bins must be placed on the curb and returned within 24 hours.
Excess rubbish must be removed by guests or collected at an additional charge.
No loose bags outside bins—birds will create a mess, incurring cleaning fees.
Damages & Breakages
All damages must be reported immediately.
Guests cannot attempt repairs without approval.
Any repair costs will be deducted from the security bond.
Furniture must not be moved. Charges apply if furniture is repositioned.
Parking & Vehicles
Up to 6 cars can be parked onsite. No street parking due to council laws.
Caravans, tents, boats, and jet skis are not allowed.
Carpooling is recommended.
Commercial Filming & Photography
Prior approval is required for commercial filming/photoshoots. Contact us for a quote.
Check-Out Instructions
Dispose of kitchen rubbish into outdoor bins.
Wash and put away all dishes.
Return one set of keys to the key safe.
Leave the second set on the garage hook.
Ensure the home is neat and tidy.
Excess cleaning fees will apply for a mess beyond normal use.
Local Council Short-Stay Accommodation Rules
Noise restrictions: No outdoor areas (pool, deck, balconies) to be used after 9:30 PM Sun-Thurs, 10:00 PM Fri-Sat.
Noise complaints (e.g., yelling, loud music, cheering) will result in a $200 security call-out fee.
Second noise complaint results in immediate eviction with no refund.
No additional guests or visitors beyond booking numbers.
No aggressive behavior, excessive drinking, or parties. Violators face fines up to $3000 and cancellation of booking.
Booking Termination
Bookings may be terminated for breaches of these terms, particularly noise, parties, or disruptive behavior.
No refunds will be given for terminations due to violations.
Cancellations & Booking Changes
60+ days before check-in: Full refund of deposits.
Less than 60 days before check-in: No refund unless the property is rebooked for the same dates and rate, minus a 10% fee.
We will do our best to accommodate date changes.
Indemnity & Release
Guests indemnify Deja View Mount Martha and the property owner against liability for injury, damage, or loss caused by their actions or omissions.
We are not responsible for loss or damage due to unforeseen circumstances (e.g., natural disasters, government regulations, theft, or acts of God).
Final Notes
Following noise and parking rules ensures a trouble-free stay.
We do not accept bucks parties, footy trips, schoolies, excessive drinking groups, DJs, or loud music.
The neighbours will report noise violations, resulting in cancellation with no refund.
Fraudulent bookings (e.g., false guest details) will be canceled immediately.
$3000 fines apply for parties or severe disturbances.
